As a workers compensation attorney, I see multiple instances where big corporations get away with violating safety rules. Sometimes these violations are egregious and intentional while other times they are just due to neglect. Unfortunately, workers continue to suffer injuries and sometimes death and the corporations often go without sanctions.
Recently, a grand jury in Ohio indicted a company and three officials in the workers death due to toxic gas. Maybe if criminal penalties were pursued more often we would not see avoidable deaths such as this and the ones we have seen in other states such as the West Virginia mining disaster at Massey Energy’s Upper Big Branch mine or the BP Gulf Oil spill.
It is time to take these corporations to task! We can no longer tolerate profit before people!
In Ohio, if you were injured as a result of these egregious violations you may be able to pursue remedies over and above a workers compensation claim. Ohio law provides for VSSR award for Violations of Specific Safety Requirements. Additionally, there may be a possibility of suing your employer if there was an intentional act or a third party if your injury was due to a faulty product.
