Ohio Attorney General Richard Cordray filed a lawsuit yesterday against GMAC Mortgage, LLC in the Lucas County Common Pleas Court. The Attorney General alleged that the mortgage loan servicer and its agents filed false and fraudulent affidavits to mislead Ohio courts in hundreds of foreclosure actions. The Toledo Blade reported on the lawsuit in their Thursday edition.
The lawsuit seeks preliminary and permanent injunctions to prevent GMAC from proceeding in its already filed foreclosure proceedings and asks for civil penalties of up to $25,000 for every violation of the Ohio Consumers Sales Practices Act.
The Ohio AG has three other lawsuits pending against other financial institutions for violation of the state’s consumer law. Kudos to Ohio AG Richard Cordray for stepping up and taking action to insure that Ohio’s laws are followed and that decptive practices are stopped!
