Contrary to popular belief, an OVI conviction cannot be expunged from an individual’s traffic or criminal record. The Ohio Revised Code provides that certain offenses are expungeable if the incident is the only offense on the individual’s record. However, the Ohio Revised Code in Section 2953.36 lists several criminal and traffic offenses that cannot be expunged, even though the individual has no other convictions. Unfortunately, a conviction for OVI is listed as an offense that cannot be expunged.
Also, it is important to know that a conviction for OVI will prevent an individual from obtaining an expungement for a prior or subsequent offense. In other words, a criminal offense committed either before or after the OVI will not be expungeable because of the OVI conviction.
