Plaintiffs are suing the manufacturers of Proton Pump Inhibitor (PPI) drugs such as Prilosec, Nexium, and Prevacid due to their lack of warning consumers of the risk of kidney damage linked to the use of such drugs.

Lawsuits that have already been filed also claim that the drug company AstraZeneca was aware of the risk for almost a decade before warning the public. Some of the kidney issues claimed in the lawsuits include:

• Kidney disease
• Kidney injury
• Kidney failure
• Acute interstitial nephritis, or AIN

Early cases resulted in successes that required these manufacturers to have stricter warnings on the medication labels under FDA guidelines, but many believe their advertising is still deceptive. More than 15,000 lawsuits have already been filed, and cases are still being collected. By 2019, the case against PPI’s had become the second-largest large scale litigation in the US.

This is not the first and only way that manufacturers of PPI drugs have been involved in legal complaints. In 2011, there was a lawsuit against AstraZeneca in which plaintiffs alleged that the PPI drug Nexium led to a higher risk of bone fractures and loss of bone density after many patients suffered from fractures during use, sometimes in the same location. In 2012 an MDL, or multidistrict litigation case, was created with all of the lawsuits. However as of 2014, the court ruled in favor of AstraZeneca, stating that the court “questioned the reliability of the expert testimony and said without it, the plaintiffs could not establish their cases”. The case was closed in 2017. Furthermore, there have been many complaints and class action lawsuits claiming that these companies do not fully disclose risks in their advertising.
